Terms

The agreements under which Rightseat is used, and the point at which the platform stops being involved.

1. Who you are dealing with

Rightseat is operated by SkyConnect BV. These terms apply to everyone who uses the platform, with or without an account.

2. What Rightseat is

Rightseat is a noticeboard. It brings together pilots who have a free seat on a flight they are making anyway and people who would like to travel with them. Rightseat is not an air carrier, not an operator and not an agent, and takes no part in the flight itself.

Any arrangement about a flight is between the pilot and the passenger. Rightseat is not a party to it, gives no guarantee that a flight will take place, and owes nothing if it does not.

3. The pilot in command

The pilot in command is solely responsible for the flight: for the airworthiness of the aircraft, for the applicable rules, for the weather, for the decision to depart, to divert or to turn back, and for everyone on board. Nothing on this platform limits or transfers that responsibility.

4. Cost sharing

Only the direct costs of a flight may be shared, and the pilot carries their own share. A seat may not be offered at a rate that leaves the pilot better off than not flying. Rightseat checks published rates against the cost of the flight and refuses those that exceed it, but the responsibility for staying within the applicable rules remains the pilot’s.

The cost share for a seat is settled directly between the pilot and the passenger and does not pass through Rightseat. Rightseat never charges a fee per seat and never takes a percentage of the direct costs. What the platform charges for is access and credits.

5. A paid pilot account

Looking around, asking about a seat and travelling as a passenger need no paid account. Publishing a flight does: a pilot account is bought for a term of 12 months, beginning on the day the payment is settled.

The first 100 pilots to settle an account keep that access for as long as the platform exists and are never asked for it again. A place is a position in the order accounts were settled in, so it does not change once taken. Every pilot after that holds access one term at a time.

A place covers the pilot account fee and nothing else, belongs to the account that took it, and cannot be passed on; closing the account ends it. It lasts as long as the platform does, and nothing is paid back if the platform stops. What an account costs is shown before you order, and a later price change never applies to a term already paid for.

6. Credits

A credit buys the asking: it is what a member spends to put a request for a seat in front of a pilot. A credit is not money, cannot be paid out, cannot be transferred to another member and has no value outside the platform. Credits do not expire.

Credits are bought, earned by introducing somebody who joins, or given by us. A credit is set aside the moment a request goes out and is spent once that request is answered; a request withdrawn before it is answered returns its credit. A credit buys the asking, not the seat: a pilot is free to decline.

7. Prices, VAT and invoices

Prices are shown in euros and include VAT where VAT is due. Which rate applies follows from where you are and, for a business, from the VAT number you supply, and is settled at the moment the order leaves the basket.

Every completed order gets an invoice, including one that was given rather than paid for. Invoices are numbered in an unbroken series per year and stay available for download in your account.

8. Paying

Payments are handled by Stripe. Rightseat never sees or stores your card details: they are entered at Stripe, and what comes back here is whether the payment succeeded. An order that is not paid within the period stated at checkout expires.

9. Renewal and cancelling

A pilot account that is not part of the founding intake renews for another term. You are told 14 days before a term runs out, and the renewal is charged after that. If it is unpaid you may still publish for 14 days after the term has ended; after that a flight can no longer be put on the site, and everything else about the account keeps working.

You can say at any time that you do not want the next term, from the invoices screen in your account. That takes nothing away from the term you have already paid for, which runs to its last day. There is no notice period and no fee for stopping.

10. Your right to withdraw

If you are buying as a private individual you have fourteen days from the day of the purchase to withdraw from it, without giving a reason. Writing to hello@rightseat.eu is enough; you may use the European model form, and you do not have to.

Because what you buy is available immediately, you are asked at checkout to agree that it starts straight away. For a pilot account, the part of the term already run is deducted and the rest refunded. For credits, every credit you have not yet spent is refunded.

A refund is paid back by the same means you paid with, within fourteen days of your withdrawal reaching us.

11. Refunds and credit notes

Outside the withdrawal period, a purchase is refunded where something went wrong on our side: an amount charged twice, a purchase that handed over nothing, or an order settled at a price that was not the one shown. Write to hello@rightseat.eu and say which order it is about.

A refund leaves the original invoice standing and adds a credit note beside it. Credits given back return to the balance and are not paid out in money.

12. Your account

You give correct information about yourself, keep your details up to date, and do not let anybody else use your account. Documents submitted for verification are your own and are genuine.

An account may be blocked or closed where there is good reason: false information, a rate that is really a fare, conduct that puts somebody at risk, or repeated failure to turn up. Where we close an account for such a reason, the part of a paid term that has not yet run is refunded and unspent credits are not.

Closing your account yourself is something you do from your settings. It ends access at once, and what is left of a paid term is not refunded unless you are within the withdrawal period described above.

13. What you may not use the platform for

  • offering flights commercially, or presenting a shared flight as a service;
  • collecting the details of other members for anything other than the flight at hand;
  • approaching members with advertising;
  • anything unlawful, or anything that puts a person or an aircraft at risk.

14. Reviews and content

What you write about a flight is your own and must be truthful. Rightseat may remove content that is untrue, abusive or unrelated to the flight it is about.

15. Liability

Rightseat provides the platform as it is. To the extent permitted by law, Rightseat is not liable for damage arising from a flight, from a cancellation, from the conduct of another member, or from information a member has entered.

16. Complaints

A complaint goes to hello@rightseat.eu. You get an answer within fourteen days, and if it needs longer than that you are told so and when to expect it. Nothing in this section takes away your right to go to court.

17. Changes

These terms may change. Members are told before a change takes effect, and continuing to use the platform after that means the new version applies. A change never alters the price or the length of a term you have already paid for.

18. Applicable law

Dutch law applies. Disputes are brought before the competent court in the Netherlands, unless mandatory law provides otherwise.
